The Service is billed in advance on a monthly or yearly basis depending on your plan and is non- refundable. There will be no refunds or credits for partial months of service, upgrade/downgrade refunds, or refunds for months unused with an open account.
All fees are exclusive of all taxes, levies, or duties imposed by your taxing authorities such as Withholding Tax, and you shall be responsible for payment of all such taxes, levies or duties.
Downgrading your Service may cause the loss of content, features, or capacity of your account. fimble does not accept any liability for such loss.
You can change your subscription type from monthly to yearly and vice versa by sending your written notice to subs@iproject.io the latest 3 business days before renewal invoice is issued.
You can cancel your subscription renewal at any time. All data can be exported from the system at any time until the subscription is cancelled.
Fimble, in its sole discretion, has the right to suspend or terminate your account and refuse any and all current or future use of the Service at any time and without prior notice in case of (a) fraudulent, criminal, grossly negligent, willful, or otherwise intentional misconduct, or violation of any law or regulation, in connection with the performance of your obligations hereunder and/or (b) demonstrated usage negatively impacting the performance of the Service and/or (c) breach of the herein Service terms and conditions, (d) any outstanding balance is not paid within 60 days from invoice date. Such termination of the Service will result in the deactivation or deletion of your Account or your access to your Account, and the forfeiture and relinquishment of all content in your Account or any other similar action deemed appropriate.
Plan features & pricing may change with a 30-day notice only comes in effect on the next billing cycle.
Fimble shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.
Account Terms
You are responsible for maintaining the security of your username and password. Fimble cannot and will not be liable for any loss or damage from your failure to comply with this security obligation. You may not use the Service for any illegal or unauthorized purpose. You must not, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
Fimble is protected by copyright laws throughout the world. Subject to your compliance with these Terms of Use, Fimble grants you a limited non-exclusive, non-transferable, revocable license to use the fimble SaaS product.
Intellectual Property Ownership - Except for the content and information you upload to Fimble, all the rest belonging to fimble (trademarks, brand names, logos and source code or otherwise referred to as the “background intellectual property” of the Echo management system has copyright and distribution rights exclusively to the Contractor and the GNU (General Public License) and is not transferred or delivered to you at anytime during the cooperation).
Fimble reserves the right to collect non-personal information solely for the analysis and forecasting of more accurate sales, inventory, ideal food cost and ideal labor cost.
Limitations on Your Use of Services - The rights granted to you in these terms of Use are subject to the following restrictions: (a) you may not attempt, authorize, encourage, support others' attempts, circumvent, reverse engineer, copy, break or otherwise alter or interfere with the fimble software; (b) you may not exploit fimble for any commercial purposes, (c) Any future updates are subject to these terms.
Fimble reserves the right, in its sole discretion, to modify the fimble product from time to time, with or without notice.
You agree to the service’s published general terms of use which can be modified with a 30-day notice.
